Terms of Use

You must be at least 13 to use SMS. If you're under 18, you need a parent or guardian's permission. You're responsible for your account and for keeping access to your email secure, since that's how you sign in. One person, one account.

When you post, comment, or vote, don't:

• Post photos of people without their permission — including baristas and their name tags. Drinks, not people.
• Harass, threaten, demean, or target anyone, including baristas and store staff.
• Post hateful, sexual, violent, or illegal content, or anything that promotes self-harm.
• Post spam, ads, links you're paid to share, or affiliate links.
• Manipulate votes or likes — no bots, scripts, multiple accounts, or vote-swapping groups.
• Impersonate another person, brand, or SMS.
• Upload content you don't have the rights to, like someone else's photo or a creator's content without credit and permission.
• Try to break, overload, scrape, or get around the security or limits of the site.

Be kind at the counter, too: order at a reasonable hour, order by the ingredients when you can, and tip your barista.

You keep ownership of the photos, captions, comments, and drink submissions you post ("your content"). By posting, you give SMS a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, adapt (for example, resize, crop, or format), and distribute your content on SMS and on SMS's social media channels and promotional materials, in connection with operating and promoting SMS. When we feature your content off the site, we'll try to credit your username. This license ends when you delete your content or account, except for copies already shared or featured before deletion, and backups we keep for a limited time.

By posting, you confirm that you have the rights to your content, and that it doesn't break these terms or anyone else's rights. Drink recipes and ordering steps you submit may be edited for clarity, accuracy, or consistency before or after they go live.

We may review, edit, hide, or remove any content, and suspend or ban any account, at our discretion — especially for breaking these terms. Photos reported by several members may be hidden automatically while we review them. We don't have to approve or keep any content, and we're not responsible for content posted by members. If you see something that breaks the rules, use the report button or email hello@secretmenusociety.com.

Drink recipes on SMS are submitted and curated by fans. They aren't official menu items, and we don't guarantee that any chain or location will make them, that ingredients will be available, or that a drink will taste the way it's described. Prices, ingredients, and availability vary by location and season, and some locations may charge extra for customizations or decline them.

Caffeine levels, flavor tags, and descriptions on SMS are general estimates, not nutrition facts. If you have allergies, dietary restrictions, a caffeine sensitivity, or a health condition, check ingredients with the store before ordering. SMS isn't responsible for reactions or other outcomes from drinks you order.

SMS is independent and is not affiliated with, endorsed by, or sponsored by Starbucks, Dunkin', 7 Brew, Dutch Bros, Sonic, or any other company named on the site. All brand names, drink names, and trademarks belong to their owners and are used only to identify the drinks and where to order them.

If you believe content on SMS infringes your copyright, email hello@secretmenusociety.com with: your contact information; a description of the work you believe is being infringed; a link to the content on SMS; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner; and your physical or electronic signature. We'll remove infringing content when appropriate and may ban repeat infringers. If your content was removed and you believe that was a mistake, you can reply to our removal notice with a counter-notice.

SMS is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will always be available, error-free, or secure, or that content on it is accurate or complete.

To the fullest extent permitted by law, SMS and the people who run it won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of SMS or content on it. Our total liability for any claim related to SMS is limited to the greater of $50 or the amount you paid us in the past 12 months (which, since SMS is free, is $0). Some places don't allow these limits, so some of them may not apply to you.

You agree to cover SMS's costs, including reasonable legal fees, if a claim is brought against us because of content you posted or your violation of these terms.

You can stop using SMS and ask us to delete your account at any time. We may suspend or end your access if you break these terms or if we need to in order to protect SMS or its members. If SMS shuts down, we'll try to give notice so you can save your content. The sections on your content license (for content already shared), disclaimers, limitation of liability, and governing law survive after your access ends.

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, and you and SMS agree to those courts' jurisdiction.

We may update these terms as SMS grows. We'll change the effective date at the top, and for significant changes we'll post a notice on the site or email account holders before they take effect. Using SMS after changes take effect means you accept the new terms.
